CUSTODY AND VISITATION
In disputes in family law, nothing is more important than the best interests and welfare of children. We have extensive experience in handling the most difficult disputes regarding custody, visitation, and the relocation of children.
EQUITABLE DISTRIBUTION OF MARITAL PROPERTY AND MARITAL DEBTS
Virginia is an equitable distribution state when it comes to dividing marital property and marital debts. The preparation required to classify, value, and equitably divide marital property and marital debts can be very difficult. We have special expertise in working with experts in preparing for equitable distribution including working with real estate appraisers, appraisers of personal property and furnishings, and experts who perform complex business valuations.
Issues involving spousal support include the determination whether a party is entitled to spousal support, if entitled how long, and what the amount of spousal support should be. In using the factors to determine spousal support under Virginia law we have developed relationships with health care providers to analyze the implications of health issues on the ability of parties to work, financial records to determine needs and the ability to pay, and experts in imputing or defending the imputation of income.
The amount of child support is generally determined by statutory guidelines. However, the determination of the income of the parents is very important, and sometimes requires an analysis of financial information that is not easily understood. We have demonstrated the ability to determine income, and when necessary, advocate the factors that allow a deviation from the guidelines.
DOMESTIC VIOLENCE AND PROTECTIVE ORDERS
The physical and emotional welfare of our clients is of utmost importance. In those cases where domestic violence has been present, we have pursued what needs to be done through the criminal laws and protective orders in civil proceedings. Where a party has been wrongly accused of domestic violence, we have experience in defending these cases.
FAULT GROUNDS OF DIVORCE
The issues pertaining to a fault grounds of divorce have great importance in the equitable distribution of marital property and marital debts, the determination of spousal support, an award of attorney fees, and may be a factor in custody and visitation cases. To present or defend fault grounds of divorce requires interviewing witnesses, health care providers such as therapists, and understanding the use of physical evidence. We have that experience.
